An Ocala, Florida woman attempted to have her DUI charge dismissed Tuesday by arguing in open court that she could not legally be impaired while driving because operating a manual transmission "requires a level of focus that scientifically counteracts alcohol consumption." Carla Jean Whitley, 58, was pulled over on Highway 441 at 11:23 p.m. after a deputy observed her 1997 Honda Civic stalling at three consecutive intersections and once in a Popeyes drive-thru. "I was not driving drunk," Whitley told Judge Eleanor Hochman. "I was driving a manual. Those are medically distinct states. You cannot be both." Whitley, who blew a .19, argued in a 9-minute statement that her arrest was procedurally flawed because: Clutch work "activates the prefrontal cortex" A stick shift requires "real-time mathematical awareness" She had successfully rev-matched twice during the stop The alcohol had been "absorbed into the gearbox, scientifically" Automatic drivers "have no right to comment on this defense" She offered to demonstrate a heel-toe downshift in the courtroom Dashcam footage showed Whitley repeatedly grinding the gears, launching the vehicle forward in second, and at one point applying the parking brake as a turn signal.
