FLORIDA MAN ARGUES HIS CRIMINAL RECORD SHOULD BE SEALED BECAUSE HE HAS PERSONALLY MOVED ON Tampa, FL -- A 29-year-old Hillsborough County man is facing a denied expungement petition after appearing before a circuit court judge and presenting a record-sealing argument that rested entirely on his own emotional progress and a journal he had been keeping since the spring. Cody Tanner, 29, told the court he was not the same person who had accumulated the record in question and that the legal system's continued attachment to events he had personally processed and released was holding him back in ways he felt the judge should consider before ruling. The judge considered them. She ruled anyway. According to the court transcript Cody's petition included: A personal statement spanning six pages describing his growth trajectory since the most recent charge eighteen months ago A request that the court weigh his internal progress against the external documentation as equal categories of evidence A character reference from a coworker who had known him for four months and described him as mostly fine A vision board he had brought in a folder that he offered to show the judge as supplemental material A closing argument that the record no longer reflected who he was and that who he was should be the court's primary concern The judge asked if he met the statutory criteria for expungement. Cody said he met the personal criteria which he felt were more relevant. He did not meet the statutory criteria. The petition was denied. Cody told the court he was going to take a moment and then move on from this too. The judge wished him well.
